- How to Reach Us
1. NATURE AND SCOPE OF SERVICES
The Services are provided for general informational and promotional purposes related to our business activities. The content available through the Services is not intended for use in jurisdictions where doing so would be unlawful or would impose additional regulatory obligations on us.
Users accessing the Services from outside France do so at their own initiative and bear sole responsibility for compliance with their applicable local laws.
2. OWNERSHIP AND PERMITTED USE OF CONTENT
The Services may feature materials owned by us, licensed to us, or provided by third parties, including layouts, text, images, graphics, audio, video, and other content (“Content”), along with any associated trademarks and branding (“Marks”). Where third-party materials are incorporated, ownership remains with the respective rights holders, subject to their licence terms.
All Content and Marks are protected under applicable intellectual property laws. Unless expressly stated otherwise, the Services and Content are made available strictly for personal, non-commercial use on an “as-is” basis.
Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, and revocable licence to access and view the Services and Content for personal purposes only. Reproduction, distribution, modification, or commercial exploitation of any Content without authorisation from the relevant rights holder is prohibited unless expressly permitted under these Terms or an applicable third-party licence.
3. ACCEPTABLE USE AND CONDUCT
By accessing the Services, you confirm that you have the legal capacity to enter into these Terms, that you are not a minor under applicable law, and that you will use the Services only for lawful purposes in compliance with applicable regulations.
You agree not to use the Services in any way that violates law or regulation, infringes third-party intellectual property or privacy rights, disrupts the security or functioning of the Services, involves fraud or deception, or introduces malware, spam, or other harmful material.
4. AUTOMATED ACCESS, DATA EXTRACTION, AND AI TRAINING PROHIBITION
You may not use any automated tool, bot, crawler, scraper, or similar technology to access, extract, or collect content from the Services without our prior written consent. This applies regardless of the technical method used or whether the purpose is commercial or non-commercial.
Using any content obtained from the Services to train, fine-tune, develop, or improve any artificial intelligence, machine learning, or generative AI system is expressly prohibited. Note that third-party content featured on the Services remains subject to the rights of its respective owners, who may independently assert their own protections.
The Services constitute a protected database under Directive 96/9/EC and applicable French law. Extraction or systematic re-utilisation of any substantial part of its contents is prohibited without our prior written consent.
Users outside France acknowledge that scraping and AI training use may additionally violate local laws. You are solely responsible for compliance with your local laws.
Breach of this section may cause irreparable harm. We reserve the right to seek all available remedies including injunctive relief, damages, and recovery of legal costs in any competent jurisdiction.
5. SUBMISSIONS AND COMMUNICATIONS
The Services do not provide a facility for publicly posting or publishing content. Any information you submit — whether through contact forms, email, or newsletter sign-up — is handled in accordance with the Privacy Notice.
You retain ownership of any content you submit. By doing so, you grant us a limited licence to use that content solely for the purpose of responding to your enquiry, delivering communications, and operating the Services, as further described in the Privacy Notice.
6. EXTERNAL LINKS AND THIRD-PARTY RESOURCES
The Services may contain links to external websites or third-party content. We do not control, endorse, or take responsibility for such materials, their accuracy, or the practices of third-party operators. Accessing external sites is at your own risk. Details regarding third-party service providers who process personal data on our behalf are set out in the Privacy Notice.
7. PLATFORM ADMINISTRATION
We may take reasonable steps to safeguard the security and proper operation of the Services and to prevent misuse. Any activities involving personal data are conducted in accordance with applicable law and the Privacy Notice.
8. DATA HANDLING AND PRIVACY
Our Privacy Notice sets out how and why we collect and use personal information in connection with the Services. It forms part of these Terms and is available at: http://www.durable-ops.com/privacynotice
Where these Terms and the Privacy Notice address the same subject, the Privacy Notice takes precedence with respect to the processing of personal data. We process information submitted through the Services solely for responding to enquiries, managing communications, and operating the Services.
9. DURATION, SUSPENSION, AND TERMINATION
These Terms remain in force for as long as you use the Services. We may restrict or suspend your access at any time for legitimate reasons, including breach of these Terms or applicable law.
10. CHANGES TO SERVICES AND AVAILABILITY
We may modify, suspend, or discontinue the Services at any time without notice. We do not guarantee uninterrupted availability and accept no liability for outages or interruptions beyond our reasonable control. We may also correct errors, inaccuracies, or omissions at any time.
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, cyberattacks, power failures, government action, or internet service disruptions.
11. WARRANTIES, DISCLAIMERS, AND LIABILITY
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all express or implied warranties. Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, or consequential loss or damage arising from your use of the Services. Nothing herein limits liability for death or personal injury, gross negligence, intentional misconduct, or mandatory statutory consumer rights.
12. APPLICABLE LAW AND DISPUTES
These Terms are governed by the laws of France, excluding the United Nations Convention on Contracts for the International Sale of Goods. EU consumers retain the benefit of any mandatory protections afforded by the law of their country of residence. The courts of Paris, France, shall have non-exclusive jurisdiction over any disputes.
13. GENERAL PROVISIONS
These Terms represent the entire agreement between you and us regarding use of the Services. If any provision is found to be unenforceable, the remaining provisions continue in full force. Nothing in these Terms creates a partnership, agency, or employment relationship between the parties.
Failure or delay by us to enforce any provision of these Terms on any occasion shall not constitute a waiver of our right to enforce that provision or any other provision on any subsequent occasion.
14. HOW TO REACH US
